1. Membership Plans & Access Pass Options
Two plans are available: Herspace Basic and Herspace Premium.
Premium includes access to all branches and additional perks, including classes, InBody tests, Ladies Gym access, and referral rewards.
Basic covers one selected self-service home gym only: Toppen, Seelong, Dato’ Onn, Kulai, Permas, or Tasek branch.
Day Pass Policy: Day passes grant single-day access to one designated user. A Day Pass is strictly tied to the individual account holder who purchased it. Day passes cannot be purchased on behalf of another person, transferred, shared, or assigned to another account under any circumstances.
2. Membership Sharing & Access Abuse (Strict Zero-Tolerance)
Individual Registration Requirement: Every individual entering the premises, whether on a monthly subscription or Day Pass, must register their own personal account, complete ID verification, and scan in using their own device.
Personal Access: Membership access is strictly personal. Sharing QR codes, facial recognition access, or allowing others to enter using another person’s account is considered fraud.
Prohibited “Tailgating”: Allowing unauthorized individuals to enter the premises, whether by opening the door, sharing access codes, or facilitating tailgating, is a severe security breach.
Penalty Charges (Per Person Basis):
For Members: Facilitating entry for non-members, such as opening the door or sharing access, will result in a penalty charge of RM200 per incident. This fine will be billed directly to the member’s account.
For Non-Members: Any individual found entering the gym without a valid membership will be subject to an immediate RM200 fine per entry. Failure to pay will result in an immediate police report for criminal trespass.
Enforcement: Proven abuse or membership sharing will result in the following:
Immediate penalty charge of RM200 billed to the person’s account.
Possible immediate suspension or termination of membership.
Possible permanent blacklist or ban from all Herspace branches.
No refunds or credits under any circumstances.
Legal Action: Herspace reserves the right to provide CCTV footage to the police and initiate legal proceedings for fraud and trespassing.
3. Personal Training Services
Personal Training (PT) services are not included in any Herspace membership plan.
PT sessions are offered as a separate paid service and are governed by the Herspace Personal Training Agreement and its respective Terms & Conditions, which operate independently from this Membership Agreement.
All matters relating to PT sessions, including booking, cancellation, session validity, trainer assignment, extensions, and refunds, shall be subject solely to the PT Terms & Conditions.
4. Subscription Model
Monthly Recurring: This is a no-contract, cancel-anytime subscription membership.
Non-Refundable: All payments are final. No refunds are provided for health issues, relocation, or lack of usage.
Grace Period: Failed payments trigger a 7-day grace period. If unpaid after 7 days, access is suspended and the loyalty tier resets to Bronze.
Tier System: Tiers upgrade automatically based on continuous active months. Upgrading or downgrading plans, or payment failures, will reset progress to Bronze.
5. Billing & Access
Payment must be successful to maintain access.
Failed payment triggers a 7-day grace period. After that, access is suspended and the tier resets to Bronze.
All payments are final and non-refundable.
6. Non-Refundable & Non-Transferable
Memberships cannot be transferred or refunded, regardless of usage, health, or relocation.
7. Tier System
Tiers upgrade automatically based on continuous active months.
Payment failure or cancellation beyond 7 days resets progress to Bronze.
Freeze periods pause tier progress but do not reset it.
8. Home Gym Policy
Members must select one home branch.
Herspace Basic members are entitled to access their selected home gym only.
Pricing and tier tracking follow the home gym rules.
9. Change of Home Gym
Once access to a selected home gym has been used within a billing cycle, the home gym cannot be changed for that same billing cycle.
Any change of home gym will result in an automatic reset to the Bronze tier, regardless of previous tier status.
Tier progression will restart based on continuous active months from the new home gym.
No tier progress, discounts, or benefits from the previous home gym will be carried over.
Herspace Premium members are exempt from home gym restrictions and enjoy all-branch access at all times.
10. Upgrade / Downgrade
Upgrading or downgrading resets the tier to Bronze.
Premium perks end immediately upon downgrade.
Downgrade requests must be made at least 7 days before the next billing date.
Upgrading may take effect immediately upon top-up.
11. Freeze Policy
Free freezes are available to all subscription members only.
One free freeze is available per year for one full billing cycle.
Additional freezes are charged at RM50 per billing cycle.
All freezes must start from the next billing cycle.
Requests must be submitted via the Herspace app before the next billing date.
12. Cancellation Policy
Annual Packages: Previous Annual Package members are on a non-cancellable and non-refundable basis for the duration of the contract term.
Subscription Members Only: The following cancellation and referral terms apply strictly to Subscription Members.
All cancellations must be completed in person at the kiosk in any branch before the next billing date.
Access remains active until the end of the paid period.
No refunds are provided for unused time.
Rejoining starts from the Bronze tier.
13. Referral Program (Premium Only)
Available to active Premium members only.
Referral rewards are applied as monthly membership discounts once both the referrer and referee remain active Premium members.
Reward Breakdown:
1 active referee = 20% off the monthly fee.
2 active referees = 50% off the monthly fee.
3 active referees = 100% off (one free month).
Referral rewards start from the referee’s second billing cycle.
Both the referrer and referee must maintain active Premium memberships for the referral discount to remain valid.
If either the referrer’s or referee’s membership status becomes halted, frozen, suspended, expired, or changes to any status other than active, the referral reward will not be applied.
Eligibility for referral rewards is determined based on the referrer’s membership payment deduction date. Both parties must have active Premium memberships when the referral reward is processed.
If a referee cancels, freezes, or downgrades their membership, the discount will automatically stop the following month.
Misuse, fake accounts, or inactive referrals will result in the removal of rewards and may lead to account suspension.
Herspace reserves the right to revise or modify referral rates, rules, and reward structures without prior notice.
14. Facility Access & Rules
Entry is via app QR code or facial recognition.
Proper sportswear is required. Slippers and casual wear are not permitted.
Outside food and open beverages are not permitted.
Herspace is not responsible for lost or damaged belongings.
Members must use equipment responsibly and in accordance with posted guidelines.
Entry to Herspace is restricted to members aged 14 years and above.
Individuals below 14 years old are strictly prohibited from entering or using the gym facilities unless they are enrolled in an active Herspace Personal Training (PT) package and are supervised by an authorized Herspace trainer.
For minors aged 14–17, registration must be completed with parental or guardian consent. Herspace reserves the right to request identification or consent documentation when necessary.
Equipment Damage & Liability: Members shall be held fully financially responsible for any repair or replacement costs arising from improper or unauthorized use, misuse, or reckless behavior resulting in damage to Herspace equipment or property. As Herspace operates on a self-service basis, Herspace accepts no responsibility for any damage or personal injury resulting from such unauthorized or improper use.
Misuse, intentional damage, or reckless behavior may result in the following:
Immediate suspension.
Charges for repair costs.
Termination without a refund.
15. Unauthorized Personal Training & Coaching (Strictly Prohibited)
Personal training, coaching, instruction, or fitness guidance by non-Herspace trainers is strictly prohibited within Herspace premises.
This includes:
Freelance personal trainers.
Paid or unpaid coaching, programming, cueing, or supervision.
Repeated instruction or guidance that reasonably resembles personal training services.
Any member found engaging in or facilitating unauthorized personal training will face immediate termination of membership without a refund.
This applies regardless of whether:
Payment is involved.
The individuals claim to be “friends”.
The coaching is informal or unpaid.
Herspace operates a zero-tolerance policy on unauthorized coaching.
Herspace reserves the absolute right, at its sole and reasonable discretion, to suspend or terminate any membership where Herspace suspects that a member is engaging in, facilitating, or benefiting from unauthorized personal training, even if conclusive proof is not available.
Such determination may be based on, but is not limited to:
Observed behavior or repeated patterns.
Reports from staff or members.
CCTV footage or access records.
Training conduct inconsistent with general member usage.
Enforcement Outcome:
Immediate termination of both the member and freelance trainer, if identifiable.
No prior warning required.
No refund, credit, or compensation.
Permanent blacklist from all Herspace branches.
Herspace reserves the right to permanently blacklist offenders from all branches.
16. Solicitation & Commercial Activity
Selling, promoting, recruiting, or soliciting any products or services inside Herspace is prohibited without written approval.
This includes supplements, programs, online coaching, external gyms, or fitness-related services.
Violations may result in termination without a refund.
17. Noise, Filming & Content Creation
Excessive noise, excessive weight dropping, or disruptive behavior is prohibited.
Filming or photography for commercial, coaching, or promotional use requires prior approval.
Herspace may request the deletion of any unauthorized content.
18. Membership Sharing & Access Abuse
Membership access is strictly personal and non-transferable.
Sharing QR codes, facial recognition access, or allowing others to enter using another person’s account is considered fraud.
Proven abuse will result in:
Immediate termination.
Permanent ban.
No refund under any circumstances.
19. Right to Refuse Entry
Herspace reserves the right to deny entry or remove any member who:
Appears intoxicated or under the influence of substances.
Is aggressive, disruptive, or unsafe.
Violates dress code, hygiene, or facility rules.
No compensation or refund shall be provided in such cases.
20. Self-Service Facility, Health & Safety
Self-Service Nature: Members acknowledge that Herspace, specifically Herspace Basic home branches, operates as an unstaffed and self-service facility.
Health & Assumption of Risk: Members must be medically fit to train and use all equipment at their own risk. Herspace accepts no responsibility or liability for any personal injury, accident, or impairment resulting from unauthorized, improper, or reckless use of equipment.
Equipment Damage & Financial Liability: Members shall be held fully financially responsible for any repair, restoration, or full replacement costs arising from improper or unauthorized use, misuse, or reckless behavior resulting in damage to Herspace equipment, facilities, or property.
21. Data Privacy
Member data is protected under Malaysia’s Personal Data Protection Act (PDPA).
CCTV and facial recognition systems are used for safety and access control.
22. Surveillance & Evidence Use
CCTV and access logs may be used as evidence in investigations of rule violations.
Herspace’s determination based on such evidence shall be final and binding.
23. Amendments
Herspace may revise prices or terms with at least 7 days’ notice via the app or notice boards.
Continued usage after updates means acceptance of the revised terms.
24. Termination Without Warning
Herspace reserves the absolute right to terminate membership immediately, without prior notice, for serious violations, including but not limited to:
Unauthorized personal training.
Access sharing.
Harassment or threats.
Fraud or false information.
No refunds, credits, or reinstatements will be provided.
25. Force Majeure & Operational Control
Herspace shall not be liable for service disruptions due to:
Maintenance.
Power outages.
Government directives.
System upgrades.
Emergencies or force majeure events.
No refunds or extensions are guaranteed unless explicitly approved.
26. General Rules
Misuse, false information, or rule violations may lead to suspension or termination.
Terminated memberships are not eligible for refunds or reinstatement.
